I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts that you conclude with us as the provider (Andreas Heinemann) via the website www.hjk-speedwings.de. Unless otherwise agreed, the inclusion of your own terms and conditions, if applicable, is objected to.

(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a legally responsible partnership that acts in the exercise of its independent professional or commercial activity when concluding a legal transaction.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By placing the respective product on our website, we make you a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the item description.

(3) The contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the "shopping cart." You can access the "shopping cart" via the corresponding button in the navigation bar and make changes at any time. After clicking the "Checkout" or "Proceed to Order" button (or a similar designation) and entering personal data as well as payment and shipping conditions, the order details are displayed as an order overview.

If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort), you will either be directed to the order overview page in our online shop or to the website of the instant payment provider. If redirected to the respective instant payment provider, you must enter the necessary details there. Finally, the order details will be displayed on the website of the instant payment provider or after you have been redirected back to our online shop.

Before submitting the order, you have the opportunity to review and change the order details (including via the "back" function of the internet browser) or cancel the order.

By submitting the order via the corresponding button ("order with obligation to pay," "buy," "place order," "pay now," or a similar designation), you legally declare your acceptance of the offer, thereby concluding the contract.

(4) Your inquiries regarding the preparation of an offer are non-binding for you. We will provide you with a binding offer in text form (e.g., by email), which you can accept within 5 days (unless otherwise stated in the respective offer).

(5) The order processing and transmission of all information required for the conclusion of the contract take place via email, partially automated. You must ensure that the email address you provide is accurate, that you can receive emails technically, and that they are not blocked by spam filters.

§ 3 Right of Retention, Retention of Title

(1) You may only exercise a right of retention if it concerns claims from the same contractual relationship.

(2) The goods remain our property until full payment of the purchase price.

§ 4 Warranty

(1) Statutory defect liability rights apply.

(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory warranty rights.

(3) If a characteristic of the goods deviates from the objective requirements, the deviation is only considered agreed upon if you were informed of it before submitting the contract declaration and it was expressly and separately agreed between the contracting parties.

§ 5 Choice of Law

(1) German law applies. For consumers, this choice of law applies only to the extent that it does not withdraw the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence (principle of favorability).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) expressly do not apply.

The technical steps for contract conclusion, the contract itself, and correction options are carried out in accordance with the provisions in the "Conclusion of the Contract" section of our General Terms and Conditions (Part I).

3.1. The contract language is German.

3.2. The complete contract text is not stored by us. Before submitting the order via the online shopping cart system, the contract data can be printed out or electronically secured using the browser's print function. After we receive the order, the order data, the legally required information for distance contracts, and the General Terms and Conditions will be sent to you again by email.

3.3. For offer requests outside the online shopping cart system, you will receive all contract data within a binding offer in text form, e.g., via email, which you can print out or save electronically.

  1. Prices and Payment Methods

5.1. The prices listed in the respective offers, as well as the shipping costs, are total prices. They include all price components, including all applicable taxes.

5.2. Shipping costs are not included in the purchase price. They are accessible via a corresponding button on our website or in the respective offer, are separately displayed during the ordering process, and must be borne by you unless free shipping has been promised.

5.3. If delivery is made to countries outside the European Union, additional costs may arise that we are not responsible for, such as customs duties, taxes, or money transfer fees (bank transfer or exchange rate fees), which you must bear.

5.4. Any costs incurred for money transfers (bank transfer or exchange rate fees) must be borne by you in cases where delivery is made to an EU member state but the payment is initiated outside the European Union.

5.5. The available payment methods are displayed on our website or in the respective offer.

5.6. Unless otherwise specified for the individual payment methods, the payment claims from the concluded contract are due immediately.

If you are a consumer, it is legally regulated that the risk of accidental loss and accidental deterioration of the sold item during shipment only passes to you upon delivery, regardless of whether the shipment is insured or uninsured. Customer Account When opening a customer account, we collect your personal data to the extent specified therein. Data processing serves the purpose of improving your shopping experience and simplifying order processing. Processing is carried out based on Art. 6(1)(a) GDPR with your consent. You can revoke your consent at any time by notifying us, without affecting the legality of the processing carried out based on the consent until revocation. Your customer account will then be deleted.

Collection, Processing, and Transfer of Personal Data in Orders When placing an order, we collect and process your personal data only to the extent necessary for fulfilling and processing your order as well as handling your inquiries. Providing the data is necessary for contract conclusion. Non-provision will result in no contract being concluded. Processing is based on Art. 6(1)(b) GDPR and is required for fulfilling a contract with you. A transfer of your data occurs, for example, to shipping companies, dropshipping or fulfillment providers, payment service providers, order processing service providers, and IT service providers. In all cases, we strictly adhere to legal requirements. The scope of data transmission is limited to a minimum.

Use of the Email Address for Sending Newsletters We use your email address exclusively for our own advertising purposes to send newsletters, provided you have expressly consented to this. YouTube is a company affiliated with Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). The function displays videos stored on YouTube in an iframe on the website. The "Extended Privacy Mode" option is activated. This means that no information about website visitors is stored by YouTube. Only when you watch a video, will information about it be transmitted to YouTube and stored there. Your data may be transmitted to the USA. Your Rights and Storage Duration

Storage Duration After complete contract processing, data is initially stored for the duration of the warranty period, then retained in compliance with legal, particularly tax and commercial law retention periods, and deleted after the expiration of these periods unless you have agreed to further processing and use.

Rights of the Data Subject You have the following rights according to Art. 15 to 20 GDPR: Right to information, rectification, deletion, restriction of processing, data portability. Additionally, according to Art. 21(1) GDPR, you have the right to object to processing based on Art. 6(1)(f) GDPR as well as to processing for direct marketing purposes.
